Latest Regulation on Visa exemption for Overseas Vietnamese and Vietnamese Relationship

The Government has just issued Decree No. 82/2015/ND-CP providing regulations on visa exemption for Vietnamese residing abroad and foreigners who are spouses, children of Vietnamese residing abroad or Vietnamese citizen.

Accordingly, there are some remarkable notes and changes in Visa Exemption as below:

–  Vietnamese residing abroad and foreigners are spouses, children of Vietnam residing abroad or citizens of Vietnam want visa exemption must ensure the following conditions:

+  Having valid passport or papers or international travel which are still valid for at least 1 year;

+  Having proof as Vietnamese who are residing abroad and foreigners are spouses, children of Vietnam residing abroad or citizens of Vietnam;

+  Not belonging to the case of not to postpone the entry and exit under provisions of Article 21 and Article 28 of the Law on Entry, exit, transit and residence of foreigners in Vietnam.

–   To resolve visa exemption, people living abroad must apply under provisions of the competent authorities of Vietnam abroad. For people temporarily residing in Vietnam to apply dossiers at the Vietnam Immigration Department (Ministry of Public Security).

–   Visa-exemption paper has a term not exceeding 5 years and a shorter than duration of passport or valid papers on international travel of people at least 6 months.

However, duration of staying time in Vietnam under the certificates of visa exemption is increased from 90 days up to 06 months (Clause 1 Article 10). Duration of staying extension is also increased from 90 days up to 06 months (Clause 2 Article 10)

–   Visa exemption paper is issued for visitors to enter Vietnam to visit relatives, settling personal affairs.

–   Visa exemption paper is granted to passports. The following cases were granted separately:

+   Visa page at passport has been over;

+   Passports issued by countries without diplomatic relations with Vietnam;

+   Valuable papers for international travel;

+   At the request of the person being granted a visa exemption;

+   For reasons of diplomacy, defense and security.

–   Visa exemption paper is granted for each person. Children who share their parents’ passports are granted visa-exemption with father or mother.

–   This Decree takes effect from November 15th, 2015. To replace Decision No. 135-2007-QD-TTg dated August 17th, 2007 and Decision No. 10/2012/QD-TTg dated February 10th, 2012.
