				<content:encoded><![CDATA[<p style="text-align: justify;">According to Circular No. 21/2018/TT-BGDDT on Regulation on organization and operation of foreign language and informatics centers, there is small difference on requirements for native and non-native English-speaking teachers.</p>
<p style="text-align: justify;">***   If a teacher is a native speaker (for a specific foreign language), he/she must possess a degree of associate and appropriate certificate in teaching skills. (It means that native teachers must have degree at any fields and teaching certificate like TESOL, TEFL, etc).</p>
<p style="text-align: justify;">***   A foreign teacher is qualified to teach foreign language if he/she achieves one of the following standards:</p>
<p style="text-align: justify;">+   He/she has a degree of associate in foreign language teacher education or higher; or</p>
<p style="text-align: justify;">+   He/she has a degree of associate in foreign language or higher and a certificate in teaching skills; or</p>
<p style="text-align: justify;">+   He/she has a degree of associate or higher, a certificate of proficiency in a foreign language at level 5, or higher, according to Vietnam’s language proficiency framework, or equivalent, and a certificate in teaching skills.</p>

				<content:encoded><![CDATA[<p style="text-align: justify;">According to <a href="https://www.vietnam-legal.com/work-in-vietnam/decree-no-112016nd-cp-guiding-some-articles-of-the-labor-code-on-foreign-workers-in-vietnam/" target="_blank">Decree No. 11/2016/QĐ-CP</a>, there are some categories under which foreigners can apply for a work permit, and they include:</p>
<p style="text-align: justify;">1. Foreign workers being reassigned in the company</p>
<p style="text-align: justify;">2. Volunteers</p>
<p style="text-align: justify;">3. Specialists</p>
<p style="text-align: justify;">4. Managers and chief executive officers</p>
<p style="text-align: justify;">5. Technicians</p>
<p style="text-align: justify;">And the Teaching position is listed on “<span style="color: #3366ff;"><strong>Specialists</strong></span>” group.</p>
<p style="text-align: justify;">According to Decree no. 11/2016/QĐ-CP, an expert means a foreign worker who:</p>
<p style="text-align: justify;">a) Has a document certifying that he/she is an expert of an overseas agency, organization or enterprise; or</p>
<p style="text-align: justify;">b) Has a bachelor’s degree or equivalent and certificate provided that he/she has worked at least 03 years in his/her training field in corresponding with the job position that he/she shall be appointed in Vietnam.</p>
<p style="text-align: justify;">However, for case of teaching in foreign language centers, kindergartens and compulsory education establishments, there are two more official letters signed by Deputy Prime Minister – Vu Duc Dam on April 12th, 2014 and August 19th, 2016.</p>
<p style="text-align: justify;">Under Official letter No. 619/TTG-KGVX dated April 12th, 2016, the Prime Minister has agreed on the grant of work permit to foreigners who possess a college diploma or higher degree and undergo the training profession which is suitable for teaching requirements at foreign language training facilities (foreign language centers), preschool education institutions.</p>
<p style="text-align: justify;">Accordingly, the foreigners who apply for the work permit to teach at foreign language centers, preschool education institutions are required to have college diploma or higher degree and have training profession suitable for teaching requirements instead of having to meet the conditions on having university degree or the equivalent and having at least 03 years of working experience under point b Clause 3 Article 3 of Decree No. 11/2016/ND-CP.</p>
<p style="text-align: justify;">Under Official letter No. 1493/TTG-KGVX dated August 19th, 2016, the Prime Minister has agreed on the case of granting work permit to foreign teacher who possesses at least a pedagogy Bachelor&#8217;s degree or the equivalent (possessing a Bachelor&#8217;s degree and a pedagogy certificate or possessing a teaching certificate in the compulsory education) to teach at compulsory education establishments.</p>

				<content:encoded><![CDATA[<p style="text-align: justify;">In most cases, a work permit is required when working in Vietnam for more than three months. Where a work permit is not compulsory, a notice must be submitted seven days in advance to the provincial Department of Labor, Invalids and Social Affairs (DoLISA) prior to working in Vietnam. Currently, work permits for foreigners are valid for a maximum of two years.</p>
<p style="text-align: justify;">In order to be eligible for a work permit, the applicant must comply with the following conditions:</p>
<p style="text-align: justify;"><strong>›</strong> Over 18 years old and have adequate health condition to match the demand of the job.<br />
<strong>›</strong> High degree of specialized knowledge, qualification and technology; experienced in management, business and other professions that the domestic labors cannot currently conduct efficiently.<br />
<strong>› </strong>If foreigners want to work in special jobs in education or health, they are required to meet all requirements of conducting health and education work of the Vietnamese authorities.<br />
<strong>› </strong>Have no criminal record in their living country, Vietnam or other countries; being not under any warrant of arrest or jailing by the Vietnamese or foreign policemen.</p>
<p style="text-align: justify;"><strong>Documents required for Vietnam Work Permit:</strong></p>
<ul style="text-align: justify;">
<li>University Diploma and 5 years experience certificate issued abroad with the same position</li>
<li>Criminal record abroad</li>
<li>Criminal record in Vietnam</li>
<li>Health check certificate at one of standard hospitals for foreigners</li>
<li>Written approval letter from Minister of People Committee to permit your business to recruit foreign labors</li>
</ul>
<p style="text-align: justify;">(All papers issued from abroad need to be made consular legalization and notarized translation into Vietnamese).</p>

<li>6 pictures size 4×6 cm</li>

<p style="text-align: justify;">Procedures to apply for Vietnam Work Permit is complicate, however, it is permission for you to work legally in Vietnam. Working in Vietnam without a work permit is still an administrative violation. Such violation is subject to administrative sanctions, but not criminal liability. Correspondingly, a foreigner may not be imprisoned but deported. An employer whose foreign employees do not have a work permit may be fined. Working in Vietnam without a work permit becomes more complicated in solving disputes (if any) in front of the Vietnamese Courts. Vietnamese legislation lacks regulations on this matter. Labour Law is one-sided to protect workers and it is a duty of employer to apply for a work permit for the employee. As a result, the employer must bear burden of proofs and discharges obligations and compensation to his employee. It is particularly recommended that foreign employee working in Vietnam must obtain a work permit.</p>
